1. Acceptance of Terms

By accessing and using the Bink Digital Solutions, LLC mobile application (the "App") and website at https://www.binkdigitalsolutions.org (the "Service"), you accept and agree to be bound by and abide by the terms and condition of this agreement.

If you do not agree to abide by the above, please do not use this service. These terms do not alter in any way the terms or conditions of any other agreement you may have with us.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on our Service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modifying or copying the materials
• Using the materials for any commercial purpose or for any public display (commercial or non-commercial)
• Attempting to reverse engineer, decompile, or disassemble the App
• Removing any copyright or other proprietary notations from the materials
• Transferring the materials to another person or "mirroring" the materials on any other server
• Using the App or materials for any illegal purpose or in any way that violates any applicable law or regulation
• Violating any third-party rights
• Sublicensing or transferring your rights to others

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Permitted Use

You may use our App for lawful purposes only. You agree not to use the App:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable material
• To impersonate or attempt to impersonate any person or entity
• To upload viruses, malware, or any other malicious code
• To collect or track personal information of others without consent
• To engage in any form of harassment, bullying, or hate speech
• To spam or send unsolicited messages
• To circumvent security or authentication measures

4. User Accounts

If you create an account on our Service, you are responsible for maintaining the confidentiality of your account information and password and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete information in your account profile
• Maintain and promptly update your account information
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account
• Not share your password or account with others

We reserve the right to terminate or suspend any account at any time for any reason, including violation of these Terms, without notice.

5. Intellectual Property Rights

All materials in the Service, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, are the property of Bink Digital Solutions, LLC or its content suppliers and are protected by international copyright laws.

You retain all rights to any content you create and share through the App. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content as necessary to operate the Service.

6.1 "As-Is" Service

The materials on our Service are provided on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

6.2 No Guarantee of Availability

We do not warrant that the App, Service, or materials will be available without interruption, that they will be error-free, or that defects will be corrected. We may perform maintenance, repairs, or updates without notice.

6.3 Accuracy

We do not guarantee the accuracy, completeness, or currency of the information provided in the Service. The information may be changed or updated at any time without notice.

7. Limitation of Liability

In no event shall Bink Digital Solutions, LLC, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, business interruption, loss of data, or other commercial damages, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from or relating to this Service shall not exceed fifty dollars ($50.00) or the amount you paid for the App or Service, whichever is less.

You agree to defend, indemnify, and hold harmless Bink Digital Solutions, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload or transmit through the Service

Our Service may contain links to third-party websites and applications. We are not responsible for the content, accuracy, policies, or practices of these external sites. Your use of third-party sites is at your own risk and subject to their terms and conditions.

10. Termination

We may terminate or restrict your access to the Service at any time for any reason, including:

• Violation of these Terms
• Illegal activity
• Abuse of the Service
• Any other reason at our sole discretion

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including indemnification, limitation of liability, and intellectual property rights) shall survive.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in effect and the unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Bink Digital Solutions, LLC regarding your use of the Service and supersede all prior negotiations, representations, or agreements.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service following modifications constitutes your acceptance of the changed Terms.
